Terms and Conditions of Sale and Website Use

These Terms and Conditions constitute a binding legal agreement between you (“the Customer” or “you”) and Techd Out (Pty) Ltd (“Techd Out”, “we”, “us”, or “our”) concerning your access to and use of our website located at www.techdout.co.za (“the Website”) and any purchase of products and services made through the Website.
1. Acceptance of Terms
By accessing or using the Website, placing an order, or engaging in any transaction with Techd Out, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. If you do not agree to these Terms, you must refrain from using the Website or transacting with us.
We reserve the right to revise these Terms at any time. Any such modifications will be effective immediately upon publication on the Website. It is your responsibility to regularly review these Terms to remain informed of any updates.
2. Website Use and Intellectual Property
All content on the Website, including but not limited to text, graphics, product descriptions, icons, software, and trademarks, is the exclusive property of Techd Out or its licensors and is protected by copyright and intellectual property laws.
You may view, download, and print content from the Website solely for personal and non-commercial purposes. You may not:

Modify, copy, reproduce, republish, upload, post, transmit, or distribute any material from this Website without express written permission;

Use any data mining, scraping, or automated tools to access or collect information from the Website;

Circumvent or interfere with security features, user access, or infrastructure.
3. Product Listings, Pricing and Availability
While we strive for accuracy, product listings, descriptions, specifications, and prices on the Website are subject to correction without prior notice.
All prices displayed are in South African Rand (ZAR) and include VAT unless stated otherwise. Prices are based on supplier cost, market conditions, and exchange rate fluctuations, and may change without warning. Techd Out is under no obligation to honour pricing that is clearly the result of a typographical or technical error.
Stock availability is not guaranteed. In the event an ordered product is unavailable, we will notify you of alternatives, a lead time, or arrange a refund at your discretion.
4. Orders, Payment, and Confirmation
We offer secure payment options via:

Direct EFT (Bank Transfer)
-
Debit/Credit Card via Yoco (limit R30,000)
EFT orders may qualify for a 3.5% discount, applied automatically on product pages. Orders placed via EFT are only confirmed once funds reflect in our account. No orders are processed or shipped without full cleared payment.
We reserve the right to cancel or reject any order for any reason, including but not limited to payment issues, suspected fraud, or pricing inaccuracies.
5. Dispatch and Delivery
Dispatch typically occurs within 1–3 working days of payment clearance. Delivery times depend on location and stock. Main centre deliveries usually take 1–3 working days post-dispatch; remote areas may require up to 5 additional days.
Techd Out uses third-party couriers for deliveries and is not liable for any delays, losses, or damages caused during transit. Shipping fees are calculated based on destination and package weight or volumetric size.
Deliveries are only made on working days. No delivery to PO Boxes, mines, farms, embassies, hotels, harbours, government buildings, or international addresses.
6. Risk and Insurance
Risk passes to the Customer upon dispatch of the goods. Basic insurance cover of up to R1,000 is included by default. Higher-value insurance can be arranged at 2.3% of the item value.
To claim for damage or loss:

Submit claim within 24 hours of receipt or failed delivery;
-
Include photographs, proof of delivery, packaging condition, and a copy of your invoice;
-
Claims are assessed by both Techd Out and the courier, and decisions are final.
7. Cancellations, Cooling-Off & Returns
7.1 Cooling-Off (ECT Act)
You may cancel an online order within 7 calendar days of delivery, per Section 44 of the ECT Act. Returned goods must be:

Unused, unopened, and in original packaging;
-
Accompanied by all manuals, accessories, and software;
-
Returned at your expense to our address.
Refunds (less courier fees) are processed within 30 days of cancellation.
7.2 Returns Outside Cooling-Off
We accept returns within 8 calendar days for unopened items in resalable condition. A handling fee of up to 25% may apply. Returns are at your cost and risk.
The following are non-returnable:

Software with broken seals;
-
Used or opened consumables;
-
Special order or personalised items;
-
Items with tampered security features.
8. Warranty and Defective Products
All products carry a manufacturer warranty (typically 12 months unless stated otherwise).
Within 6 months of purchase:

Defective items may be repaired, replaced, or refunded (excluding shipping);
-
We will cover collection and return courier fees (only for original deliveries);
-
You must notify us in writing of the fault and provide necessary documentation.
After 6 months, manufacturer warranty applies:

Customer covers all logistics unless otherwise agreed;
-
We will coordinate with suppliers and keep you updated. Assessments may take up to 6 weeks.
We are not liable for defects caused by:
-
Wear and tear, surge damage, misuse, improper installation, or unauthorised modifications;
-
Incompatibility with third-party software or systems not recommended by the manufacturer.
9. Special Conditions: Open Box, Custom Builds, and Special Orders
Open Box:
-
Items marked “open box” are not refundable but carry the full warranty unless otherwise stated.

Packaging may be incomplete but accessories are included.
Special Order Items:
-
Cannot be cancelled or refunded once payment is made.
-
ETA is an estimate and not binding.
Custom PC Builds:
Cancellation fees:
-
Preparation: R1,000 or 5%
-
Assembly: R5,000 or 17.5%
-
Completion: R10,000 or 25% plus courier
10. Limitation of Liability
To the maximum extent permitted by law, Techd Out will not be liable for:
-
Any indirect, special, incidental or consequential damages;
-
Loss of profit, data, business or opportunity;
-
Claims exceeding the value of the defective product itself.
11. Disputes and Governing Law
All disputes must first be referred to us in writing. Should resolution fail, the matter may be referred to arbitration in Pretoria under AFSA rules. These Terms are governed by the laws of South Africa, and the courts of South Africa have jurisdiction.
12. General

These Terms override any conflicting verbal or written statements by staff or agents.

If any clause is found unenforceable, the remainder shall remain in force.

No waiver of rights shall be deemed a continuing waiver unless expressly confirmed in writing.
